Pourquoi deux protections complémentaires ?

Le Certificat d’Obtention Végétale (COV) protège une variété dans son ensemble, tout en permettant l’« exemption du sélectionneur » : une variété protégée peut être utilisée librement par son concurrent, pour son propre programme de recherche et la création de nouvelles variétés.

Le brevet, quant à lui, ne protège pas une variété Il peut protéger un caractère spécifique créé par un moyen technique, sous réserve du respect strict des critères de brevetabilité, notamment la nouveauté et l’inventivité, tels qu’ils sont définis par la directive 98/44/CE et appliqués par l’Office européen des brevets (OEB).

Pour l’UFS, ces deux outils peuvent être mobilisés de manière complémentaire selon la nature de l’innovation. Leur articulation doit toutefois préserver le modèle « d’innovation ouverte » spécifique au secteur semencier qui permet aux sélectionneurs d’accéder aux variétés existantes pour en créer de nouvelles.

Six principes de l’UFS pour préserver l’innovation ouverte

1. Garantir une exemption limitée du sélectionneur en matière de brevets, afin de permettre l’utilisation d’une variété contenant un caractère breveté pour créer de nouvelles variétés.

2. Maintenir la non-brevetabilité des méthodes conventionnelles de sélection et permettre l’usage des marqueurs brevetés dans le cadre de la création variétale.

3. Exclure de la brevetabilité les caractères natifs et ceux issus de la mutagénèse aléatoire, qui relèvent de la diversité naturelle ou des méthodes conventionnelles.

4. Veiller à une application rigoureuse des critères de brevetabilité, notamment la nouveauté, l’inventivité et la description suffisante.

5. Renforcer la transparence sur les caractères brevetés présents dans les variétés commercialisées, au moyen d’une information accessible et fiable.

6. Faciliter l’accès aux licences à des conditions équitables, raisonnables et non discriminatoires, avec une attention particulière portée aux petites entreprises.
